Agreement to Terms

By downloading, installing, accessing, or using HookSmith AI (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. We may update these Terms from time to time, and your continued use of the App constitutes acceptance of any changes.

Description of Service

HookSmith AI is a mobile application that uses artificial intelligence to help users generate hooks, scripts, and video content for social media platforms. The App provides:

• AI-powered generation of hooks and scripts
• Content creation and management tools
• In-app recording and teleprompter features
• Subscription-based access to premium features

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time with or without notice.

User Accounts

To access certain features, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

You are solely responsible for maintaining the confidentiality of your account and password. We are not liable for any loss or damage arising from your failure to protect your account information.

Subscription Terms

HookSmith AI offers subscription plans with various features:

• Subscriptions are billed through Apple's App Store
• Payment will be charged to your App Store account
• Subscriptions automatically renew unless cancelled
• You can manage or cancel subscriptions in your App Store account settings
• No refunds are provided except as required by law

Trial periods, if offered, automatically convert to paid subscriptions unless cancelled before the trial ends. Price changes will be communicated in advance, and you may cancel before the change takes effect.

User Content

You retain ownership of all content you create, upload, or generate using the App ("User Content"). By using the App, you grant us a limited, non-exclusive, royalty-free license to:

• Store and process your User Content to provide the service
• Use anonymized, aggregated data for service improvement

You represent and warrant that:

• You own or have rights to all User Content
• User Content does not violate any third-party rights
• User Content complies with applicable laws and regulations

You are solely responsible for your User Content and any consequences of sharing or using it.

AI-Generated Content

The App uses artificial intelligence to generate content. You understand and agree that:

• AI-generated content may not always be accurate, appropriate, or suitable for your needs
• You are responsible for reviewing, editing, and verifying all AI-generated content before use
• We do not guarantee the quality, accuracy, or effectiveness of AI-generated content
• AI-generated content may sometimes produce errors or inappropriate content

You agree not to use AI-generated content for any illegal, harmful, or malicious purposes. We reserve the right to restrict or prohibit use of the App if you violate this provision.

Prohibited Uses

You agree not to use the App to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm others
• Create content that is defamatory, obscene, or harmful
• Attempt to reverse engineer or compromise the App's security
• Use automated systems to access the App in violation of rate limits
• Share your account credentials with others
• Interfere with or disrupt the App's operation

We reserve the right to suspend or terminate accounts that violate these prohibitions.

Intellectual Property

The App, including its design, features, and functionality, is owned by HookSmith AI and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to:

• Use the App for your personal or commercial content creation
• Access and use features according to your subscription tier

You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or proprietary notices

All trademarks, service marks, and logos are the property of their respective owners.

Termination

We may terminate or suspend your access to the App at any time, with or without cause or notice, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the App will immediately cease
• You may lose access to your account and User Content
• We may delete your account and User Content

You may terminate your account at any time by deleting it through the app settings. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Disclaimers and Limitations of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the App will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of AI-generated content

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE APP.

Our total liability for any claims related to the App shall not exceed the amount you paid for your subscription in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless HookSmith AI, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, your User Content, or your violation of these Terms.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after such modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the App and delete your account.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HookSmith AI operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the appropriate courts of that jurisdiction.
